Japan Inheritance Guide for Egypt (エジプト) Nationals

This guide explains how Japanese inheritance law and tax apply to Egypt nationals living in or inheriting property from Japan. There are approximately approx. 3,000 Egypt nationals residing in Japan.

1. Applicable Law (準拠法)

Under Japan's Act on General Rules for Application of Laws (法の適用に関する通則法, Article 36), the inheritance of a person is governed by the national law of the decedent.

Egyptian Civil Code and Law No. 77 of 1943 (on inheritance) govern succession for Muslims. Personal Status Law applies based on the decedent's religion. Egypt follows the nationality principle.

Renvoi (反致): Generally Does Not Apply

Egyptian private international law (Article 17 of the Civil Code) applies the national law of the decedent to succession matters. Egypt generally does not accept renvoi for personal status matters including inheritance.

2. Tax Obligation Type (課税範囲)

Unlimited Taxpayer

Taxed on all worldwide assets.

Applies if: domiciled in Japan, OR foreign national with residence visa who has lived in Japan for 10+ years.

Limited Taxpayer

Taxed only on assets in Japan.

Applies if: not domiciled in Japan, OR foreign national who has lived in Japan for less than 10 years.

Japan has a tax treaty with Egypt that may provide relief from double taxation.

3. Egypt Inheritance Law

  • Islamic inheritance shares (faraid) apply mandatorily to Muslim decedents: specific Quranic fractions for each heir
  • Testamentary disposition limited to 1/3 of the estate and cannot benefit a legal heir without consent of other heirs
  • Non-Muslim Egyptians (Copts, etc.) follow their own personal status law which may allow broader testamentary freedom
  • Egypt imposes inheritance tax at 0% for the first EGP 500K, then progressive rates up to 5%

Statutory Inheritance:

Islamic law: wife receives 1/8 (with children) or 1/4 (without). Sons receive double the share of daughters. Parents each receive 1/6 if there are children.

Egyptian court-issued certificate listing all legal heirs and their Islamic shares.

Consular Authentication

Egypt is NOT a Hague Apostille Convention member. Documents require consular legalization through the Egyptian Embassy.
